Trial Date Set in FBC Daycare Abuse Case

The former First Baptist Church Daycare employee charged with criminal abuse is scheduled to go to trial next spring following her appearance in Christian County Circuit Court Wednesday morning.

Deshayla Day was indicted on a charge of first-degree criminal abuse — a Class D felony. She is accused of grabbing a child by the face and lifting a 16-month-old child by one arm and taking them from a classroom to a hallway. At least one of the incidents was captured on video.

A Hopkinsville Police detective testified that the child was taken to the hospital for treatment of visible injuries.

Judge John Atkins set Day’s trial for May 20.

Day is represented by Jason Holland while Graves County Commonwealth’s Attorney Richie Kemp was appointed the special prosecutor in the case and still plans to present the case despite a change in the Christian County Commonwealth’s Attorney’s office.
