The attorney for a Clarksville juvenile charged with murder has asked the court to throw out a superseding indictment because the charge did not originate in juvenile court.
Doug Moore represents 17-year-old Oziya Narcisse, who is charged with shooting Isiah McCoy during a party at a Carbondale Drive home in Oak Grove in May.
Narcisse was indicted by the Christian County grand jury in August but was certified by the court to stand trial as an adult in November when he first appeared in Christian County Circuit Court.
A new indictment has been filed in the case, however, Moore argued on Thursday the case should go back to juvenile court first because the initial indictment was defective. Assistant Commonwealth’s Attorney Mark Gilbert disagreed with Moore’s assessment.
